Single Status Affidavit

If you are planning to marry in another country, you may be required to obtain a Certificate of Non-Impediment. Another name of this document is a single status affidavit. A single status affidavit is a sworn statement that you are eligible to marry. No standard 'Certificate of Freedom to Marry' document exists in the United States. The affidavit needs to be commissioned by a commissioner of oaths. It is a sworn document for you to take to another country that says that you are single and not married and that you are able to be married in another country.
In the past, the U.S. Embassy allowed American citizens to swear such an affidavit of eligibility to marry before a U.S. consular officer. Now such documents still are of great importance for those who are planning to go abroad. The United States no longer has a standard document; however you can prepare a sworn affidavit attesting to your freedom to marry. Single Status Affidavit document is also known as: Certificate of No Record, Certificate of No Impediment, Single Status Statutory Declaration, and Certificate of Legal Capacity to Contract Marriage Single Status Certificate.
In the single status affidavit form, an individual is required to fill in information that states under oath that they are single and not married to any other party. Almost all countries require that a couple can provide such a certificate before they will issue a marriage license.  Then has to be certified by the Secretary of the State Office of the state where the document is executed (Apostille of Certification for non-Hague countries). The affidavit should be less than 3 months old when it is presented to the Town Hall for your license - otherwise it is not valid. It is a good idea to get it a few weeks before you come to the intended country. Embassy requirements for an affidavit of single status may allow people to simply make and sign a sworn statement in front of a notary or embassy official, saying that they are unmarried and are free to marry.
Check with the authorities of the country whether you need an affidavit or a statutory declaration and if you can use this STATUTORY DECLARATION OF SINGLE STATUS.  At the county court clerks office in the county court house, were they issue marriage license, you can find a single status affidavit form.  The easy way to obtain Single Status Affidavit is to go to Courthouse where your county is.  If you choose applying for a single status affidavit via mail, within a minimum of four business days, you will receive the final official document in the mail.
